Saira Health Care Clinic owns and operates the website www.sairahealthcare.com and pharmacy.sairahealthcare.com. By accessing our website, scheduling a consultation, or purchasing prescribed medications, you agree to be bound by the following Terms and Conditions.

If you do not agree with these terms, you must discontinue the use of our services immediately. By using our services, you acknowledge that you have read, understood, and agreed to abide by every clause mentioned below.


1. Medical Disclaimer & Nature of Treatment

  • 1.1. Informed Consent: The Patient understands that treatments or therapies provided by Saira Health Care are based on the latest medical knowledge available to us and the Unani system of medicine. While we strive to provide the best treatment option at the time of diagnosis, medical results cannot be guaranteed. The Patient gives their informed consent to undergo treatment and acknowledges that they have been fully informed of potential risks, benefits, and alternatives.
  • 1.2. No Guarantee of Cure: We provide treatment based on medical expertise; however, we do not claim to treat or cure every patient. Disease conditions can fluctuate, and individual responses to medical interventions vary. If the treatment provided does not yield satisfactory results, the Patient is advised to seek a second opinion from another healthcare provider.
  • 1.3. Herbal Treatment Timeline: We currently offer herbal and Unani treatment options. These may take longer to show results compared to conventional medical treatments. You understand that the pace of recovery depends on individual factors and agree to continue the treatment as advised to achieve optimal results. Deviation from the treatment plan may impact efficacy.
  • 1.4. Dr. Qasmi’s Nuskhas: Specific formulations "Nuskhas" are created under the supervision of Dr. Nizamuddin Qasmi solely for his patients. These are personalized to specific needs and health conditions. Unauthorized reproduction, distribution, sharing, or sale of these Nuskhas is strictly prohibited.
  • 1.5. Adverse Effects: Some medicines prescribed to treat your condition may cause adverse effects. In some cases, patients may experience high adverse effects. Saira Health Care and its owners do not assume liability for adverse effects caused by prescribed medicines. If you experience side effects, discontinue use immediately and consult Dr. Nizamuddin Qasmi or a qualified healthcare professional.

2. Consultation Policies

  • 2.1. Consultation Fees: In consideration of the services provided, the Patient agrees to pay the following fees. While actual fees are ₹500, we are currently offering a discounted rate:
    • Voice Call Consultation: ₹300
    • Video/In-Person Visit Consultation: ₹400
    • Patients are consulting form outside India: ₹500
    • Note: These fees are subject to change without prior notice.
  • 2.2. Validity of Fee: All consultation fees are non-refundable and non-transferable. Each fee is valid for a single phone call or in-person visit only. If you require further assistance after the initial consultation concludes, you may reach out via the Doctor’s personal email ID. Any additional calls or visits will incur a new consultation fee.
  • 2.3. Cancellation Policy: Cancellation or rescheduling of appointments must be made at least 24 hours in advance. Failure to do so may result in a cancellation fee.
  • 2.4. Cost Estimates: The duration of treatment and estimated cost of services cannot be confirmed prior to consultation. Patients are requested not to inquire about treatment costs at the reception or during initial interactions, as a thorough evaluation by the doctor is required first.

3. Patient Conduct & Confidentiality

  • 3.1. Confidentiality: The Patient agrees that all information and records related to their treatment will be kept confidential and shall not be disclosed to any third party without the Patient's prior written consent.
  • 3.2. Communication Channels: Patients are required to discuss their treatment progress with their assigned Doctor or medical provider only. Patients are not authorized to share or discuss treatment progress with reception staff or personnel not directly involved in their care to prevent miscommunication. Non-compliance may result in termination from our practice.
  • 3.3. Conduct and Behaviour: We expect all patients to maintain a respectful attitude. Any form of misbehaviour, abuse, or harassment towards our doctors, staff, or other patients will not be tolerated.
    • Legal Consequence: In case of any such incident, we reserve the right to take action under the Uttar Pradesh Medical Protection Act, 2013, including reporting the matter to authorities.

4. Pharmacy & Medication Policies

  • 4.1. Purpose of Pharmacy Website: The website pharmacy.sairahealthcare.com is exclusively for patients under the treatment of Dr. Nizamuddin Qasmi to order prescribed medicines. It is not for the purpose of general public sales. Patients must consult Dr. Qasmi before placing any order.
  • 4.2. Prescription Integrity: The Doctor will prescribe medicines based on medical diagnosis. The Doctor will not alter or modify a prescription upon a patient's request. Changes are made only at the Doctor's discretion.
  • 4.3. Usage Instructions:
    • Always read instructions properly before use.
    • Use the recommended dose for the recommended duration only.
    • Never use another person's medicine.
    • If you purchase medicines from another store, verify them before use.
    • You agree to inform the Doctor about any allergies or on-going medications before starting treatment.
  • 4.4. No Returns on Medicines: It is generally not possible to return medicines once dispensed as they are personalized and may have specific storage requirements. Therefore, medicines cannot be returned, reused, or resold.
  • 4.5. Custom Preparations (Nuskhas) & Batch Variations: Dr. Qasmi’s Nuskhas are prepared in very small batches exclusively for patients under the treatment of Dr. Nizamuddin Qasmi. Please note that each batch may exhibit slight differences in color, taste, consistency, and other physical properties compared to previous batches. These variations occur due to natural fluctuations in the availability and quality of raw ingredients in the market, as well as inherent nuances in the small-batch preparation process. Such differences are considered normal and acceptable in the practice of alternative medicine. Consequently, patients do not have the right to return or exchange medicines based on these minor physical variations, as these factors are beyond standardized control.

5. Order, Payment & Shipping Terms

  • 5.1. Payment Terms:
    • Prepaid Only: We do not offer Cash on Delivery (COD). Full payment is required at the time of order placement.
    • Pricing: All prices quoted by customer service are final and non-negotiable. We do not offer discounts on medicines.
  • 5.2. Order Confirmation: Once an order is booked, it cannot be cancelled, returned, or refunded. Customers are strongly advised to confirm their orders before payment.
  • 5.3. Domestic Delivery (India):
    • Timeline: Typical delivery takes 4-5 working days. Delays may occur due to unforeseen circumstances.
    • Patient Responsibility: Upon dispatch, the Patient must ensure they are available to receive the call and the parcel. If the parcel is returned due to the Patient being unreachable, incorrect address, or unavailability, the Patient is responsible for paying the return courier charges AND the cost of rebooking/reshipping. No refunds will be provided in these cases.
    • Courier Errors: If a parcel is returned solely due to a courier mistake (not patient error), we will resend the parcel via another service. No refund will be provided; only a replacement shipment.
  • 5.4. International Delivery:
    • Timeline: International orders typically take approximately 2 weeks.
    • Customs: Delivery times are subject to customs clearance in India and the destination country. Saira Health Care is not responsible for delays or issues arising from customs clearance.
    • Refunds: If an international customer does not receive their medicine due to shipping issues, we will only provide a refund once we receive the medicines back at our facility. The refund process may take 5-7 working days after receipt of the return.
    • Collection Responsibility & Non-Delivery: In certain instances where door delivery is not feasible at the patient's location, it is the patient's responsibility to collect the parcel from the designated local hub or collection center. If the patient fails to collect the order within the timeframe set by the carrier, or if storage fees are incurred due to delay, the patient must pay these charges. If the parcel is returned to us due to non-collection, the patient is liable for both the original shipping charges and any return shipping fees. We will only refund the remaining balance (after deducting these costs) once the parcel is successfully received back at our facility; no refund can be initiated without the physical receipt of the returned goods.
    • Duties & Import Charges: We prepay all standard door delivery charges available at the time of booking. However, if the destination country imposes additional fees—such as custom duties, import taxes, or local handling charges—the patient is required to pay them to clear the shipment. Saira Health Care cannot bear these costs, as they are government-mandated, vary by country, and are entirely beyond our control.

6. Medical Records & Diagnostic Tests

  • 6.1. Record Keeping: The Patient agrees to allow the Clinic to maintain accurate and up-to-date medical records of their treatment, including test results and medications.
  • 6.2. Diagnostic Investigations: We do not provide investigation facilities within our clinic. We may recommend suitable diagnostic centers, but the Patient is free to choose any center. We are not responsible for the cost or outcome of investigations conducted outside our clinic.

7. Jurisdiction & Governing Law

  • 7.1. Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of India.
  • 7.2. Dispute Resolution: Any disputes arising out of or in connection with these terms, services, or products shall be subject to the exclusive jurisdiction of the courts at Barabanki, Uttar Pradesh, India.
  • 7.3. Liability: The website and its owners do not assume responsibility for the misuse of prescribed medicines or for adverse health outcomes. Reliance on the information provided on the website is at your own risk.
